MEMBERSHIP AGREEMENT TERMS
This is a minimum 12 month agreement, renewed automatically monthly thereafter unless written notice is provided by the Member to Fitness World. Written notice must be delivered by certified or registered mail at least 15 days before the automatic renewal date. Address: 1521 West Walnut, Jacksonville, IL 62650.

1. RIGHT TO TERMINATION AND CANCELLATION: The contract may be cancelled within three business days after the first business day after signing, with all monies refunded. If the member moves more than 25 miles and Fitness World cannot provide services under the agreement, the member may cancel and owes only the allocable charges plus a reasonable fee not exceeding 10% of the unused balance or $50, whichever is less. In the event of death or disabling condition preventing use, the member may cancel and owes only charges allocable before death or disability. Cancellations must be in writing by certified or registered mail.

2. MEMBER'S HEALTH WARRANTY: Member represents that they have no disability, impairment or ailment preventing active or passive exercise or detrimental to health, safety or physical condition.

3. MEMBER'S INDEMNITY AGREEMENT: Buyer assumes responsibility for each person who becomes a member under this contract and agrees to indemnify Fitness World, its affiliates, agents and employees against liability incurred by such member.

4. RULES, REGULATIONS AND SCHEDULES: Members agree to abide by Fitness World rules, regulations and schedules, which may be amended by management.

5. MEMBERSHIP KEYTAG: No one is admitted without a valid membership key tag or registering as a day guest. Memberships are not transferable.

6. REPLACEMENT KEYTAGS: Lost or damaged key tags may be replaced during the membership year for $10 upon positive identification.

7. GUEST POLICY: Non-members must register prior to entry and pay the current guest fee.

8. SUSPENSION: Management may terminate membership for non-payment or behavior inimical to other members. A member may request suspension with a written doctor's order when significant disability prevents use.

9. MEMBER OBLIGATIONS: Except upon proper cancellation or transfer, members remain obligated to agreed payments; dues compensate eligibility to use facilities, not actual usage.

10. DISHONORED CHECKS: A $25 service charge may be assessed for each dishonored check or draft, and current and past-due balances may be collected.

11. ENTIRE AGREEMENT: This is the entire agreement; modifications must be in writing and approved by management.

12. UNPAID BALANCES: Balances over 30 days may incur a $20 late fee. Discontinued pre-authorized payments make the unpaid balance due; member owes collection, legal and attorney costs.

13. LOCKERS: Lockers are for member convenience; management may remove items left overnight.

14. VALUABLES: Members should avoid valuables. Fitness World is not liable for loss, theft or damage to personal property.

15. CHANGE OF ADDRESS: Members must notify Fitness World in writing of address or name changes.

16. CHANGE OF MEMBERSHIP: If one family member discontinues after the 12-month obligation, the remaining member is charged the one-member monthly rate.

17. SPECIAL OCCASIONS: Management may limit club usage for tournaments and special parties.

18. INTERRUPTION OF SERVICE: During a long-term interruption of all services, Fitness World may freeze memberships and add lost time once services resume.
